Court Rejects Nnamdi Kanu’s Request for Transfer to National Hospital in Abuja

A Federal High Court in Abuja has upheld the Department of State Services’ position that IPOB leader Nnamdi Kanu should face trial over alleged terrorism-related activities.

Justice James Omotosho rejected Kanu’s request to be moved from DSS custody to the National Hospital, Abuja, for medical treatment. Ruling on a no-case submission by his counsel, Onyechi Ikpeazu (SAN), the judge held that a prima facie case had been established against Kanu. He explained that at this stage, the court is only required to determine whether there is a case that requires a defence, not proof beyond reasonable doubt.

The court therefore ordered Kanu to open his defence, noting it was in his interest to address the allegations. On the medical request, the judge directed the President of the Nigerian Medical Association to constitute a panel including a cardiologist, a neurologist, and the Chief Medical Director of the National Hospital, Abuja. The panel is to assess Kanu’s health, file its report within eight days, and submit it to the court. The case was adjourned until October 8 for consideration of the medical panel’s report.
