Nigeria Data Protection Commission warns content creators against filming citizens without consent, threatens sanctions

Nigeria’s data protection watchdog has cautioned content creators against recording members of the public without first obtaining their consent. The agency also warned that social media platforms that fail to curb such practices could face sanctions and possible criminal action. In a statement issued on Friday, the commission said it had received reports about individuals secretly taking photos or recording videos of unsuspecting people and posting them online. It described the trend as a violation of citizens’ constitutional right to privacy.

The commission referenced a particular case involving a content creator in Lagos who reportedly stands along roadsides to film passers-by for what she calls a “reality show.” According to the agency, initial findings show that the activity does not serve any public or legitimate purpose.It stressed that such actions breach citizens’ right to informational self-determination as protected under Section 37 of the 1999 Constitution and the Nigeria Data Protection Act, 2023.

The statement explained that capturing and sharing people’s images in such situations requires their consent unless the creator can justify the act under other lawful grounds for data processing.Preliminary investigations, the commission said, suggest that the practice amounts to a deliberate invasion of privacy, especially as those filmed do not expect their images to be recorded and shared online by strangers.

The National Commissioner and Chief Executive of the commission, Dr. Vincent Olatunji, has therefore directed major social media companies—including TikTok, X and Meta—to strengthen enforcement of their community guidelines to prevent harm caused by unlawful handling of personal data. He warned that the commission would not hesitate to sanction any platform that fails to promptly address violations. The commission further emphasised that content creators remain personally responsible for their actions and could face criminal prosecution if they violate the privacy rights of individuals in Nigeria.
