KPMG’s chairman-elect, Michael Ebeid, has issued a formal apology for dismissing allegations raised by a whistleblower as he seeks partner backing in an upcoming leadership vote. The apology follows parliamentary disclosures revealing that earlier external legal reviews cleared the firm without basic investigative procedures, such as reviewing staff emails or conducting direct interviews.

Public Apology and Parliamentary DisclosuresEbeid issued a personal apology to Labor Senator Deborah O’Neill after previously characterizing her parliamentary statements regarding the whistleblower’s claims as “completely false.” The allegations—which centered on senior KPMG partners misusing confidential client audit documents to secure lucrative contracts—have since been substantiated following further internal reviews.I

In a letter released by the parliamentary committee investigating the matter, Ebeid acknowledged that his initial defense of the firm’s internal processes was wrong, naive, and inaccurate, thanking the committee for uncovering the misconduct.Flaws in Initial Legal ReviewsDocuments released by the committee after waiving legal professional privilege highlighted significant gaps in the initial investigations conducted by major law firms Allens and Ashurst: Allens concluded in a December report that the whistleblower’s claims were unsubstantiated, deciding that searching staff emails was “disproportionate and unnecessary” due to the credibility of the executives involved. Subsequent investigations confirmed that senior partners had improperly accessed and stored confidential Lendlease board documents.

Ashurst issued a report clearing KPMG personnel based solely on limited documentation, explicitly noting in its findings that investigators had not interviewed any of the individuals involved to assess their credibility. Executive Departure and Governance ImpactThe ongoing scrutiny and substantiated findings have triggered widespread executive turnover across KPMG’s leadership structure:Former chief executive Andrew Yates, chairman Martin Sheppard, and chief operating officer Eileen Hoggett have all departed the firm. Audit partner Kim Lawry stepped down from her senior roles following a request from client Westpac, while independent board members Mike Baird and Patty Akopiantz have also left their positions.

KPMG’s new chief executive, John Sams, informed partners that while the firm acknowledges parliamentary oversight, the published legal reports reflect an earlier stage of the process and do not represent the current status of the ongoing investigations. Ebeid’s appointment as permanent chairman remains subject to a partner vote concluding this week.
